Acceptable Use Policy
|
To use Webspeed Internet and/or other services, you must comply with the provisions of this Acceptable Use Policy at all times.
Please note that in this Acceptable Use Policy, "we"/"us"/"our" denotes Webspeed, and "you"/"your" denotes you the customer.
Overview
This Acceptable Use Policy applies to all Webspeed services and your use of them. All services and equipment are supplied subject to your acceptance of both our Acceptable Use Policy and Terms & Conditions.
We reserve the right to modify these policies at any time, effective upon posting the modified document to this URL:

Violation of our Acceptable Use Policy is prohibited and may result in criminal and civil liability. We will investigate incidents involving such violations and may involve and will co-operate with relevant authorities if a criminal violation is suspected.
Use of Services
The following constitute violations of this Acceptable Use Policy, but are not limited to:
- Unacceptable Use
Use the service to post, transmit or otherwise distribute material which is known or ort to be know to be false, unlawful, libelous, defamatory, profane, invasive of another’s privacy, abusive, harassing, threatening, harmful, vulgar, obscene, sexually explicit, hateful or otherwise objectionable.
Use the service to post, transmit or otherwise distribute any software which contains a virus, bug, malicious code, "cancelbot", "trojan horse", "worm" or other harmful or disruptive component.
- Illegal Use:
Use the service to upload, download, post, reproduce, or otherwise distribute material which constitutes, or encourages conduct that , intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations disseminated thereunder. Prohibited activities include, but are not limited to the following:
- Posting or disseminating material which is unlawful (such as child pornography or obscene materials).
- Transmitting pirated software or other software not properly and currently licensed.
- Conducting or participating in illegal gambling.
- Fraudulent activity, including misrepresenting oneself to harm others, impersonating others, or falsely presenting or altering written or electronic signatures; and
- Soliciting for or participating in pyramid and other illegal schemes.
- Protection of Individual Rights and Minors:
Use the service to harm, or attempt to harm, minors in any way, collect or attempt to collect, personal information about third parties without their knowledge or consent. All users further agree they will not attempt to collect or use any personal information from a minor (anyone under 18 years old) without appropriate prior verifiable parental consent.
- Spam and Unsolicited Commercial Email/Unsolicited Email
Use the service or the Webspeed Network to post, transmit or otherwise distribute messages considered to be unsolicited commercial email or unsolicited email 'Spam' however large or small the quantity, including without limitation, junk mail, chain mail, and informational announcements, inappropriate postings to news groups, false commercial messages, or any other abuse of e-mail or news group servers.
Webspeed does reserve the right to email its own customer base with items concerning service outages, customer account information, new product announcements, etc.
- Unauthorized Access/Use
Use the service to access, or to attempt to access, data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system and/or network or to breach security or authentication measures without express authorisation of the owner of the system or that network.
Interference with the service to any user, host or network including, but not limited to, mail-bombing, packet flooding, spoofing, deliberate attempts to overload or crash a host or network, broadcast attacks, denial of service attacks, port and network scanning or perform or attempt to perform a malicious act which may reasonably result in harm or damage to the webspeed network, or to another party’s network, hardware, software, privacy, or use of the internet.
Install automated search and retrieve programs or similar automated and manual routines which generate excessive amounts of Internet traffic.
- Copyright Infringement
Use the service to transmit, upload, download, post, or otherwise reproduce, distribute or provide access to information, software or other material which infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party.
- Reselling the Services
Reselling the Services without Webspeed’s authorization. The Services are for your use only.
- Your Equipment
It is the customers responsibility to ensure that the computer system used to access and use the service meets the minimum requirements stated by Webspeed as being necessary to use the service. From time to time, the computer equipment required to access and use the service may change. Accordingly, the customers’s computer equipment may cease to be adequate to access and use the service.
- Broadband ADSL Fair Use
As a contention-based service, the amount of bandwidth available for all users is limited, based on the contention ratios of the service. As such all users must share the available bandwidth. In a perfect world, all users would obtain an equal share of the available bandwidth and users would experience a consistent service.
Unfortunately, some users are able to work around the contention or simply take significantly more data than the average user on which the contention ratio modeling has been done. Such users take a disproportionately greater share of the available bandwidth and, as a consequence, the majority of users suffer a diminished experience. The statistics show that 5% of users download 40% of the total data downloaded. These are our heaviest users. Unfortunately, they have an adverse impact on the experience of other users.
Listed below is a guide to maximum fair use download/upload per calendar month:
- 500-250-50 Service - 3 GB
- 1000-250-50 Service - 6 GB
- 2000-250-50 Service - 12 GB
Users who abuse the service will receive written notification of excessive use and Webspeed reserves the right to either charge on a per GB basis or move users to a lower contention or higher speed service and charge the published rate for that service.
By agreeing to our Acceptable Use Policy and Terms & Conditions you acknowledge your responsibility to follow the guidelines contained within these documents, as well as ensure your computers/networks are properly maintained, updated/firewalled, and protected by anti-virus software as necessary.
Webspeed does not assume any responsibility for the acts or omission of a customer or any user of the service. Account and password information must be kept secure and is the responsibility of the customer.
